8.1. Strict Prohibition on Unauthorized Likeness Use
Users may not upload, publish, distribute, sell, license, or otherwise make available any 3D models, textures, animations, scans, or AI-generated content that depict, replicate, simulate, or are substantially similar to the likeness, face, body, voice, biometric data, or other identifiable attributes of any real person (including celebrities, public figures, private individuals, or minors) without prior explicit written consent from that individual.
For deceased individuals, legally valid authorization from the estate or rights holder must be obtained where required by applicable law.
8.2. Deepfake and AI-Generated Likeness Content
Any AI-generated, machine learning-generated, or digitally manipulated content that recreates or imitates a real person (“Deepfake Content”) is strictly prohibited unless:
(a) The uploader possesses clear, written, legally valid authorization from the person depicted (or their legal representative);
(b) Such authorization explicitly permits commercial distribution;
(c) The uploader can provide verifiable proof of such authorization upon request.
Failure to provide documentation upon request may result in immediate removal and account suspension.
8.3. Absolute Ban on NSFW Deepfakes
The Platform strictly prohibits the creation, upload, sale, or distribution of any sexually explicit, pornographic, intimate, or otherwise NSFW content depicting or simulating a real person without their explicit written consent.
This prohibition applies regardless of whether the individual is a public figure or private person and applies even if the content is labeled as parody, satire, or fictional.
Content involving minors in any sexualized or exploitative context is strictly prohibited and will be reported to appropriate authorities.
8.4. Compliance with United States Law
Users acknowledge that unauthorized commercial use of a person’s likeness may violate:
- State Right of Publicity laws
- Privacy and misappropriation laws
- Defamation laws
- Emerging state-level regulations concerning synthetic media and deepfakes
Users are solely responsible for ensuring compliance with applicable federal and state laws, including post-mortem publicity rights where recognized.
8.5. Compliance with European Union / EEA Law
Users acknowledge that unauthorized processing or commercial use of identifiable likeness data may violate:
- The General Data Protection Regulation (GDPR)
- Personality and image rights under applicable national civil laws
- The EU Artificial Intelligence Act (where applicable)
- Unfair commercial practices and consumer protection regulations
Where biometric or identifiable data is involved, lawful basis and explicit consent are required under EU data protection law.
8.6. No Implied Endorsement or Association
Content must not suggest endorsement, sponsorship, partnership, or affiliation with any real individual unless prior written consent has been obtained.
8.7. Uploader Responsibility and Indemnification
The uploader bears full legal responsibility for ensuring that their content does not infringe any intellectual property, privacy, publicity, personality, biometric, or other rights.
By uploading content, users agree to indemnify, defend, and hold harmless the Platform, its owners, affiliates, officers, and employees from any claims, damages, liabilities, losses, or legal expenses arising out of or related to violations of this policy.
8.8. Platform Enforcement Rights
The Platform reserves the right, at its sole discretion, to:
- Request proof of consent at any time
- Remove content without prior notice
- Suspend or permanently terminate accounts
- Report unlawful content to authorities
- Cooperate with law enforcement or regulatory bodies
The Platform may take action regardless of whether a formal complaint has been received.
9. Mandatory Arbitration and Class Action Waiver (United States Users Only)
9.1. Agreement to Arbitrate
If you are located in the United States, you agree that any dispute, claim, or controversy arising out of or relating to the Platform, these Terms, or the use of the services shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided below.
9.2. Scope of Arbitration
This agreement to arbitrate applies to all claims, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, including claims relating to privacy, publicity rights, synthetic media, AI-generated content, or intellectual property.
9.3. Arbitration Procedure
Arbitration shall be administered by a recognized arbitration provider in accordance with its applicable rules. The arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
9.4. Class Action Waiver
YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
9.5. Exceptions
Either party may bring an individual claim in small claims court if eligible. The Platform may seek injunctive or equitable relief in court for intellectual property infringement or unlawful misuse of the Platform.
9.6. Opt-Out Right
Users may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by providing written notice to the Platform. Failure to opt out constitutes acceptance of this arbitration provision.
10. Synthetic Media Transparency and AI Content Disclosure
10.1. Mandatory Disclosure
Users must clearly and accurately disclose when content has been created, modified, or enhanced using artificial intelligence, machine learning, generative models, or other automated systems.
Such disclosure must be visible in the product description and include a statement that the content contains AI-generated or AI-assisted elements.
10.2. Prohibition on Deceptive Synthetic Media
Users may not upload or distribute synthetic media that is intended to mislead, impersonate, deceive, manipulate, or falsely represent real individuals, organizations, or events.
10.3. No Political Manipulation
Synthetic media designed to influence political opinions, public elections, public policy, or civic processes through impersonation or fabricated likeness of real persons is strictly prohibited.
10.4. Biometric and Identifiable Data
Where AI-generated content processes or simulates biometric identifiers (including facial geometry or voice patterns), users must ensure compliance with applicable data protection and privacy laws, including obtaining explicit consent where legally required.
10.5. Platform Labeling Rights
The Platform reserves the right to apply its own labeling, warnings, or transparency notices to any AI-generated or synthetic media content.
10.6. Audit and Removal Rights
The Platform may audit AI-generated content for compliance with transparency requirements and remove or restrict access to content that fails to meet disclosure standards.
